Administration, or ‘Compulsory Administration’ as it is sometimes known, is a statutory mechanism designed to protect owners and the integrity of a strata or community titles scheme when normal governance, or compliance,  has broken down.

What Is an Administrator?

An Administrator is essentially a statutory manager appointed to step into the shoes of the body corporate — and in some cases the committee or even lot owner — to make decisions, manage finances, resolve dysfunction or comply with earlier orders.

The role exists to protect owners and the scheme where ordinary governance structures are no longer functioning effectively, or there has been a significant, or ongoing, noncompliance with earlier orders.

Powers of an Administrator

The powers of an Administrator depend on the terms of the appointment order made by the Magistrates Court or the Adjudicator appointed by the Commissioner. Appointments may be full or limited in scope.

Full Administration

Under a full administration, the Administrator exercises all functions of the body corporate and the committee, which may include:

Entering into contracts

Managing disputes

While owners retain their rights in respect of their individual lots, general meetings may be suspended during the period of full administration.

An administrator may be appointed where a scheme is unable to function properly, including where the committee is deadlocked or non-functional, the body corporate cannot form a committee, serious conflict prevents decision-making, legislative obligations are not being met or earlier orders are not being complied with.

Applications for the appointment of an administrator may be made by a lot owner, a mortgagee, another interested party, or the Commissioner, depending on the circumstances and applicable legislation.

The powers of an administrator depend on the order made by the Tribunal or the Commissioner’s Adjudicator. Powers may be broad or limited and are defined by the scope of the appointment.
