Bugden Allen acts for Frasers Property in advising on and implementing the titling and management structures for the entirety of Midtown. This involves various stages of stratum and strata subdivisions and drafting of 88B instruments for subdivisions, management statements and by-laws. The first 3 stages of the development, MAC, Soul and Treehouse have been successfully completed. Bugden Allen also acts for Frasers on preparing all master sales contracts for each stage and the project conveyancing.

Coordinating Expert Evidence in a Complex Building Defects Matter

Bugden Allen was engaged by the Owners Corporations to coordinate and prepare expert evidence in support of potential building defect litigation. This was detailed against the parties responsible for the development’s construction, in favour of the OCs.

Our role involved working with appropriately qualified independent consultants, reviewing the existing technical material and rectification history, identifying gaps in the available evidence and developing a coordinated approach to further investigation.

Rather than treating each reported issue as a separate maintenance problem, we sought to ensure the experts considered whether the defects were symptoms of broader design, construction or installation issues.

The Walden by ALAND is luxury residential development in North Sydney. The 30 storey luxury residential tower will contain 161 apartments with premium amenities including concierge, rooftop pool, wellness areas and wine cellars. Bugden Allen acted for ALAND on preparation of the master sales contract to be used for the sale of all residential lots in the development as well as the titling and management documents. Bugden Allen also act for ALAND on the project conveyancing having successfully launched the project in late 2025 with very strong sales results at launch. Bugden Allen was in attendance at launch day to work with ALAND and the sale agents to digitally issue and exchange contracts at launch using the OPEX system and continues to act for ALAND with the ongoing sales.

The Waterfront, Shell Cove is a major coastal master planned residential, commercial and lifestyle precinct anchored around the Shellharbour Marina on the South Coast of NSW, about 90 km south of Sydney. It is being jointly developed by Frasers Property Australia and Shellharbour City Council, with development activity spanning decades and now in its final stages. Bugden Allen acts for Frasers Property Australia on the title and management structuring, preparation of title documents, 88B instruments and the master sales contracts for various stages of this significant mixed-use development. This includes master sales contracts and development agreements for land sales, house and land sales and off the plan apartment sales.
